On October 16, 2007, President Bush signed S. 1612, a bill amending the International Emergency Economic Powers Act (IEEPA). The new amendments significantly increase penalties for violations of U.S. export regulations, including deemed export provisions.

Under applicable Commerce Department rules, businesses and universities may be required to obtain export licenses prior to the release of certain sensitive technologies to foreign nationals in the U.S . depending on the nature of the technology and the foreign national's home country. This requirement, known as the "deemed export rule," treats foreign national access to technology in the U.S. as "deemed" to be an export of that technology to the foreign national's home country. Failure to identify the issue and, where applicable, failure to obtain the appropriate license, may result in visa delays and denials, foreign national deployment problems, civil penalties including loss of export privileges, and criminal sanctions.

Under the new law, civil penalties may now be imposed in an amount of up to the greater of $250,000 per violation, or twice the amount of the underlying transaction. Similarly, criminal penalties have increased accordingly and now include a fine of up to $1,000,000 and/or imprisonment for up to 20 years per violation. Prior to enactment, civil penalties were capped at $50,000 per violation, with criminal penalties limited to a maximum of $250,000 and/or imprisonment for not more than 10 years.

Not only have civil and monetary sanctions increased five-fold, but the new law also expands the criminal provisions to include conspiracy to violate and aiding or abetting a violation. In addition, the new penalties are retroactive for civil violations if subject to pending or subsequently commenced enforcement actions, and are retroactive for criminal violations if based on enforcement actions commenced on or after enactment.

In a related move, on October 11, 2007, the Department of Justice (DOJ) announced the National Counter-Proliferation Initiative to harness and coordinate the counter-proliferation assets of U.S. law enforcement, licensing, and intelligence agencies, including ICE, to combat the growing national security threat posed by illegal exports of restricted U.S. military and dual-use technology. The DOJ stated in a press statement that "[t]he threat posed by illegal foreign acquisition of restricted U.S. technology is substantial and growing," including efforts by Pakistan, China and Iran in particular. "Foreign states and terrorist organizations are actively seeking to acquire U.S. data, technological knowledge and equipment that will advance their military capacity, their weapons systems and even their weapons of mass destruction programs. Many have targeted our government, industries and universities as sources of these materials," according to Kenneth L. Wainstein, Assistant Attorney General for National Security. The announcement follows the appointment of a career DOJ prosecutor to serve as the first National Export Control Coordinator, a move that many see as suggestive of an upcoming rise in enforcement actions and prosecutions.

Regular Expressions

A regular expression (regex or regexp for short) is a special text string for describing a search pattern. You can think of regular expressions as wildcards on steroids. You are probably familiar with wildcard notations such as *.txt to find all text files in a file manager. The regex equivalent is .*\.txt$.

But you can do much more with regular expressions. In a text editor like EditPad Pro or a specialized text processing tool like PowerGREP, you could use the regular expression \b[A-Z0-9._%+-]+@[A-Z0-9.-]+\.[A-Z]{2,4}\b Analyze this regular expression with RegexBuddy to search for an email address. Any email address, to be exact. A very similar regular expression (replace the first \b with ^ and the last one with $) can be used by a programmer to check if the user entered a properly formatted email address. In just one line of code, whether that code is written in Perl, PHP, Java, a .NET language or a multitude of other languages.
